1. Introduction

Welcome to Rated. These Terms and Conditions govern your use of the Rated application. By accessing or using Rated, you agree to be bound by these Terms and Conditions. If you do not agree with these terms, please do not use Rated.


2. Use of Rated

Eligibility: You must be at least 18 years old to use Rated. By using Rated, you represent and warrant that you are at least 18 years old.

Account Registration: You may be required to create an account to access certain features of Rated. You agree to provide accurate and complete information when creating your account and to keep this information up to date.

User Responsibilities: You are responsible for maintaining the confidentiality of your account information, including your username and password, and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.


3. Privacy

Your use of Rated is also governed by our Privacy Policy, which can be accessed here. By using Rated, you consent to the collection, use, and sharing of your information as described in the Privacy Policy.


4. Aviation Mechanic Certificate Requirements

The Aviation Mechanic certificate has two ratings - the Airframe (A) and the Powerplant (P). If you decide to seek both ratings, this is commonly referred to as an "A&P Certificate".


You must be:

• At least 18 years old; and

• Able to read, write, speak, and understand the English language.


You must have at least:

• 18 months of practical experience with the procedures, practices, materials, tools, machines, and equipment generally used in constructing, maintaining, or altering an airframe or powerplant, appropriate to the rating sought; or

• 30 months of practical experience concurrently performing the duties appropriate to both the airframe and powerplant ratings.


You may also be eligible:

• By graduating from an FAA-approved Aviation Maintenance Technician School (AMTS);

or

• By completing the Joint Service Aviation Maintenance Technician Certification Council (JSAMTCC) training course for military personnel. You should be familiar with Title 14 of the Code of Federal Regulations (14 CFR) part 65, subpart D, Mechanics.


5. Intellectual Property

Ownership: Rated and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio) are owned by Rated, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

License: We grant you a limited, non-exclusive, non-transferable, and revocable license to use Rated for your personal, non-commercial use only. You agree not to use Rated for any other purpose.


6. Prohibited Activities

You agree not to:

• Use Rated in any way that violates any applicable federal, state, local, or international law or regulation.

• Engage in any activity that interferes with or disrupts Rated or its servers or networks.

• Attempt to gain unauthorized access to any portion of Rated or any other systems or networks connected to Rated.

• Use Rated to impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity.

• Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of Rated.


7. Termination

We reserve the right to terminate or suspend your account and access to Rated, without prior notice or liability, for any reason, including if you breach these Terms and Conditions. Upon termination, your right to use Rated will immediately cease.


8. Disclaimer of Warranties

Rated is provided on an "AS IS" and "AS AVAILABLE" basis. Rated makes no representations or warranties of any kind, express or implied, as to the operation of Rated or the information, content, materials, or products included on Rated. You expressly agree that your use of Rated is at your sole risk.


9. Limitation of Liability

To the fullest extent permitted by applicable law, Rated shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses, resulting from

• (a) The use or the inability to use Rated;

• (b) Unauthorized access to or alteration of your transmissions or data;

• (c) Statements or conduct of any third party on Rated; or

• (d) Any other matter relating to Rated.


10. Indemnification

You agree to indemnify, defend, and hold harmless Rated, its affiliates, and their respective officers, directors, employees, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms and Conditions or your use of Rated.


11. Changes to the Terms and Conditions

We may revise and update these Terms and Conditions from time to time in our sole discretion. All changes are effective immediately when we post them and apply to all access to and use of Rated thereafter. Your continued use of Rated following the posting of revised Terms and Conditions means that you accept and agree to the changes.


12. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the United States and the State of Virginia, without regard to its conflict of law principles.
